Terms of service
Plain language, no hedging. This page says what you buy, how credits work, what we owe you and what we expect back.
Last updated 27 August 2026 Legal review pending
Part A
Applies to every customer — sections 01 to 08, 10 to 12.
Part B
Adds section 09 when you hold an Agency Pack.
Founder Addendum
Signed separately; prevails for its signatory only.
01
Who we are, who you are
The service is TheStakk, operated by legal entity to be supplied — Aitomik, registration number and registered address — from Sens, France (“we”, “us”).
TheStakk is a business tool. By creating an account you confirm you are acting for professional purposes, on behalf of a company or as a professional. The service is not offered to consumers, and consumer law protections do not apply.
Two ways of using the service exist, and both are covered here: direct customers (Part A applies) and agencies distributing the service white-label to their own clients (Parts A and B apply). Founding agencies additionally hold a separate, individually signed Founder Addendum; where it conflicts with these terms, the Addendum prevails for its signatory only.

Definitions
Seven words carry the whole contract.
- Credit
- The platform’s billing unit, equal to 300 tokens of model input and output. Each run is metered on real consumption and rounded up to the next whole credit.
- Plan pool
- The monthly credit allowance included in your subscription, bonus credits included.
- Top-up
- Credits purchased on demand, billed to the exact credit.
- Workspace
- Your isolated environment on the platform.
- Client workspace
- A white-label workspace an agency provisions for one of its clients.
- Agency Pack
- The add-on subscription enabling white-label multi-client management.
- Run
- One execution of an application.
03
Account
You are responsible for the accuracy of your account information, for the confidentiality of your credentials, and for everything done under your account. Notify us without delay at info@thestakk.com if you suspect unauthorised access. One account per legal entity unless we agree otherwise in writing.

Plans, credits and billing
These rules are the contract. They are the same rules displayed in the product.
- Subscriptions are monthly, payable in advance, and renew automatically until cancelled. Cancellation takes effect at the end of the current billing cycle; no pro-rated refunds of the current cycle.
- The plan pool resets every cycle. Unused pool credits do not roll over, without exception. If you regularly lose credits, the product will suggest a smaller tier; you can change tier in two clicks.
- Bonus credits attach to the plan pool only. They never apply to top-ups.
- Top-ups are billed to the exact credit at a flat rate, identical for every customer and every plan. The total price is displayed before you confirm each purchase. Top-up credits expire 6 months after purchase, are consumed oldest-first, and their expiry date is shown at purchase and in your account. Expiring balances are flagged 30 days in advance.
- Welcome credits (500 at signup) expire 30 days after account creation and are consumed before any other credits. Consumption order thereafter: plan pool, then top-ups, oldest first.
- Metering is per run, on real token consumption, rounded up to the next credit. Your consumption, per application and per run, is visible in your account at all times; invoices are built from those records.
- Tier changes. Upgrades take effect immediately; an upgrade never reduces your available credits. Downgrades take effect at the next renewal; the current cycle’s pool is kept in full. A downgrade below the minimum plan required by an active Agency Pack is blocked (see 09).
- Non-payment. If a payment fails we retry and notify you. Access may be suspended X days to be supplied after an unpaid invoice; your data remains exportable during suspension.
05
Fair use
You agree not to: use the service for unlawful content or purposes; attempt to breach workspace isolation or access another customer’s data; resell raw platform or model access outside the agency features provided; overload or disrupt the service; use outputs to develop a competing model.
We may apply reasonable rate limits to protect the platform. Violations may lead to suspension after notice, or immediate suspension where the integrity of the platform or other customers’ data is at risk.
06
Your content, our platform
Your content stays yours — inputs and outputs alike. You grant us the licence strictly necessary to process inputs and return outputs, and nothing more.
The platform, its applications, its code and its branding are ours; these terms grant you a right of use, not a licence to copy, resell or reverse-engineer the platform itself. Feedback you volunteer may be used to improve the service without obligation to you.
07
AI outputs — a warning that matters
Outputs are generated by artificial intelligence from your inputs. They can be inaccurate, incomplete or inappropriate for your purpose despite our engineering.
08
Service, support and changes
We operate the service with reasonable skill and care, publish incidents on a status page, and answer support at info@thestakk.com. formal SLA: none at this stage, to confirm
We improve the platform continuously; if a change materially reduces what you bought, we notify you by email at least 30 days ahead, and you may terminate before it takes effect. These terms themselves change the same way: material changes announced 30 days ahead by email, previous version kept available; continued use after the effective date is acceptance.
09
Agency mode
Part B — applies when you hold an Agency Pack.
Packs and capacity. Each pack allows a maximum number of client workspaces and requires a minimum base plan.
Agency 1
5
client workspaces
min. Standard plan
Agency 2
12
client workspaces
min. Pro plan
Agency 3
25
client workspaces
min. Scale plan
Agency 4
50
client workspaces
min. Max plan
At the cap, creation of new client workspaces is blocked until you upgrade; existing client workspaces are never blocked or degraded by the cap. Pack downgrades that would leave you above the lower pack’s cap, or below your pack’s minimum plan, are blocked with an explicit message.
- White label. We grant you, for the duration of your pack, the right to distribute the applications to your clients under your own brand, domain and legal pages. We stay invisible to your clients and never contact them. You do not represent yourself as the developer of the platform to third parties beyond the white-label presentation the product provides.
- Your clients are yours. You set your prices freely; we take nothing from them. The contract with your client is yours, and so are the obligations that come with it. Before deploying your first client workspace you must have your own terms of service and privacy policy in place for your clients — the product gives you custom legal pages for exactly this purpose. Data protection roles across the chain are set out in the Data Processing Agreement.
- Credit wallet. Your pool is shared across your workspaces. You may distribute credits to a client workspace and recall undistributed, unconsumed credits to your pool at any time. Consumption is metered per client workspace and exportable for your rebilling.
- Managed and delegated access. You may operate client workspaces without a client email (managed accounts) or step into a client-operated workspace with the client’s consent; delegated access is recorded in the audit trail.
- If you leave. Your clients are yours, your workflow logic is yours, and your data and execution history are exportable at any time. Remaining top-up credits stay usable until their expiry date while the account is open; unconsumed credits are not refunded in cash. refund of top-ups on termination: to confirm
10
Liability
Nothing in these terms excludes liability that cannot be excluded under French law. Subject to that: we are not liable for indirect damages — lost profits, lost revenue, loss of data caused by your own deletion, reputational loss.
Our total aggregate liability under these terms is capped at the amounts you paid us in the 12 months preceding the event cap to confirm. You indemnify us against third-party claims arising from your content, your use of outputs, or — for agencies — your contracts with your clients.
11
Term and termination
Either party may terminate at any time, effective at the end of the current cycle. We may terminate or suspend for material breach after 15 days’ written notice unremedied, or immediately for the violations described in 05.
After closure: your data and execution history remain exportable for 30 days, then deletion follows the Privacy Policy schedule; sums due remain due; sections 06, 07, 10 and 12 survive.
12
Law and jurisdiction
These terms are governed by French law. Any dispute that cannot be resolved amicably falls to the competent commercial court, venue to be supplied.
If any clause is held invalid, the rest stands. These terms, the order process, the Data Processing Agreement and, where applicable, the Founder Addendum form the entire agreement; the Data Processing Agreement prevails on data protection matters.
This page is a draft pending legal review. Amber items: legal entity and registration; suspension delay; SLA position; refund of top-ups at termination; liability cap; venue.
Every rule stated here restates the billing specification v1.8; none has been invented for this page.
